– Delegated Regulation supplementing Regulation (EU) No 1305/2013 on support for rural development by the European Agricultural Fund for Rural Development (EAFRD) (Rural development Regulation) and introducing transitional provisions (7637/14 + 7637/14 ADD 1)
Rural development Regulation foresees altogether 14 empowerments to define technical arrangements in a delegated act. These relate to the definition of young farmers, arrangements for farm and forestry visits, quality schemes and promotion, content of the business plan under investment measures, afforestation, rules for commitments and activities under agri-environment-climate measure, conservation of genetic resources - both in agriculture and forestry, calculation methods to avoid double financing, scope for animal welfare commitments, rules for support under cooperation, duration of commercial loans contracted to mutual funds, common rules for investment measures and energy efficiency infrastructure, definition of conditions applicable to conversion or adjustment of commitments under area related measures, and transitional rules which are not covered by the basic act (EU) No 1310/2013 on transitional measures for the CAP reform.
Delegated Regulation supplementing Regulation (EU) No 1306/2013 (Horizontal Regulation) with regard to the integrated administration and control system and conditions for refusal or withdrawal of payments and administrative penalties applicable to direct payments, rural development support and cross compliance (7642/14)
The aim of this act is to adopt one delegated act supplementing Regulation No 1306/2013 on the financing, management and monitoring of the common agricultural policy (Horizontal Regulation). It establishes common rules as regards basis for the calculation of administrative penalties for non-compliances with obligations relating to direct payments, rural development and crosscompliance; rules on withdrawals or refusals of undue payments in case of nonrespect of eligibility conditions under direct payments or rural development; as well as certain rules concerning obligations relating to permanent pasture under cross-compliance. Some transitional measures are also provided for to enable smooth entry into force of the new rules supplementing the Horizontal Regulation as compared to the previous legal framework.
– Delegated Regulation supplementing Regulation (EU) No 1306/2013 (Horizontal Regulation) with regard to public intervention expenditure (7641/14 + 7641/14 ADD 1)
The purpose of this delegated act supplementing the Horizontal Regulation, is to lay down rules concerning the rules with regard to public intervention expenditure.
– Delegated Regulation supplementing Regulation (EU) No 1306/2013 (Horizontal
Regulation) with regard to paying agencies and other bodies, financial management, clearance of accounts, securities and use of euro (7640/14 + 7640/14 ADD 1)
The purpose of this delegated act supplementing the Horizontal Regulation is to lay down rules concerning the rules, derogations and transitional measures with regard to paying agencies and other bodies, financial management of the agricultural funds, clearance of accounts, securities and use of euro.
– Delegated Regulation supplementing Regulation (EU) No 1307/2013 establishing rules for direct payments to farmers under support schemes within the framework of the common agricultural policy (Direct payments Regulation) and amending Annex X to that Regulation (7646/14 + 7646/14 ADD 1).
This delegated act supplements Direct payments Regulation and provides further rules in relation to certain general provisions, the basic payment scheme, the single area payment scheme, the payment for farmers observing agricultural practices beneficial for the climate and the environment (´greening´ payment), the payment for young farmers commencing their agricultural activity, voluntary coupled support, the crop-specific payment for cotton and in relation to the notifications necessary with regard to the support schemes.
The detailed rules in this delegated act provide further clarification concerning the
greening practices along the above-mentioned principles laid down in the basic act.
– Delegated Regulation supplementing Regulation (EC) No 73/2009 and Regulation (EU) No 1307/2013 (Direct payments Regulation) as regards the basis of calculation for reductions to be applied to farmers by Member States due to the linear reduction of payments in 2014 and financial discipline for calendar year 2014 (7656/14).
The act provides a linear reduction of direct payments in respect of 2014 and an adjustment for reasons of financial discipline in the context of Direct payments Regulation.
– Delegated Regulation supplementing Regulation (EU) No 1308/2013 establishing a common organisation of the markets in agricultural products (Single CMO Regulation) by amending Regulation (EC) No 555/2008 as regards new measures under the national support programmes in the wine sector (7636/14)
The purpose of this delegated act is to lay down rules concerning three new elements introduced by the reform of the Single CMO Regulation concerning the national support programmes in the wine sector. This is a sub-measure of the measure of promotion measure concerning promotion of wine in Member States and a measure of innovation in the wine sector, and an extension of the measure on restructuring and conversion of vineyards to cover replanting of vineyards following mandatory grubbing-up for health or phytosanitary reasons.
– Delegated Regulation supplementing Regulation (EU) No 1308/2013 (Single CMO) and Regulation (EU) No 1306/2013 (Horizontal Regulation) by amending Regulation (EU) No 543/2011 relating to the fruit and vegetables and processed fruit and vegetables sectors (7658/14).
The purpose of this delegated act is to lay down rules concerning elements introduced by the new Single CMO regarding operational programmes in the fruit and vegetables sector and entry price system, extend two provisions already in force in the scheme under current provisions and clarify the rules concerning certain recognition criteria, as well as introducing a step by step sanction mechanism in case of non-compliance with recognition criteria.
- Delegated Regulation supplementing Regulation (EU) No 1308/2013 (Single CMO Regulation) as regards the support programmes for the olive-oil and tableolives sector (7654/14)
The purpose of this delegated act is :
– to incorporate the provisions of the current Single CMO Regulation (Regulation (EC) No 1234/2007) as regards the work programmes to support the olive-oil and table-olive sectors which will be repealed,
– to integrate the new components introduced for those work programmes the new Single CMO Regulation (Regulation (EU) No 1308/2013. From now on, those programmes could cover the areas ‘market follow-up and management in the olive-oil and table-olives sector´, ‘the improvement of the competitiveness of olive cultivation through modernisation´ and ‘the dissemination of information on measures carried out by´ the recipient organisations ‘to improve the quality of olive oil and table olives´.
– Delegated Regulation supplementing Regulation (EU) No 1308/2013 (Single CMO) by amending Regulation (EC) No 826/2008 as regards certain requirements related to the agricultural products benefiting from private storage aid (7648/14 + 7648/14 ADD 1)
The purpose of this delegated act is to lay down additional requirements as regards quality and product characteristics for flax fibre, cheese with a protected designation of origin (PDO) or, a protected geographical indication (PGI) and skimmed milk powder made from cow´s milk. These products will become eligible for private storage aid under Single CMO Regulation.
– Delegated regulation supplementing regulation (EU) No 1308/2013 (Single CMO)
by amending Regulation (EC) No 288/2009 as regards the granting of aid for accompanying measures in the framework of a School Fruit and Vegetables Scheme (7657/14).
In the context of the reformed CAP, Single CMO Regulation establishing a common organisation of the markets in agricultural products provides for the eligibility to the EU aid of accompanying measures necessary to ensure the successful implementation of the School Fruit and Vegetables Scheme. The purpose of this delegated act is to lay down detailed rules concerning the eligible costs, the financial ceilings and other elements necessary for the eligibility of accompanying measures for the Union cofinancing.
The Commission has announced its intention to adopt a second wave of delegated acts after the European Parliament recess.
